Terms and Conditions of The Digital Museum Platform (DIGMUS)
- Introduction and Acceptance
This document sets out the terms and conditions (“T&C”) governing the use of The Digital Museum platform (hereinafter, “the Platform”) by users. By accessing or using the Platform, you agree to these T&C. If you do not agree with any of the terms set out herein, please do not use the Platform.
- Definitions
- Platform:
The Digital Museum streaming platform, including its website, mobile applications and any other means of access. - User:
Any person who accesses and/or uses the Platform. - Content:
Any audiovisual material, including videos, still images, text, animations, sculptures, renders, 360º spaces for Virtual Reality, functional elements with Augmented Reality, music, podcasts, audio guides and any other content available on the Platform. - Account:
The profile created by a User to access the Platform’s services.
- Use of the Platform
- Registration and Account:
To access certain functionalities of the Platform, you may need to create an account by providing accurate and up-to-date information. The User is responsible for keeping their username and password confidential. - Prohibited Content:
Users must not upload, share or distribute Content that is illegal, obscene, defamatory or that infringes the intellectual-property rights of third parties. - Acceptable Use:
The User undertakes to use the Platform in a lawful and respectful manner, without attempting to access restricted areas not intended to be accessible, nor interfering with the normal operation of the Platform. - User-Generated Content:
If the Platform allows Users to create and upload Content, they will be responsible for the Content they generate and share. The Platform reserves the right to remove any Content that violates these T&C.
- Intellectual Property
- Copyright:
All Content available on the Platform is protected by copyright and belongs to its respective owners. - Licence to Use:
The User is granted a limited, non-exclusive and non-transferable licence to access and view the Content available on the Platform for personal, non-commercial purposes. - Prohibition of Copying and Distribution:
The User may not copy, distribute, modify or create derivative works from the Content available on the Platform without the prior authorisation of the copyright owners.
- Payment and Subscriptions
- Prices and Plans:
The Platform offers different access modalities through the purchase of digital content and subscription plans with various features and prices. Prices and plans are subject to change, and Users will be notified in advance. - Payments:
Users must make the corresponding payments for their purchases and subscriptions using the payment methods available on the Platform. - Cancellation and Refunds:
Cancellation of a subscription and refund policies will be governed by the specific terms of each plan. One-off purchases of content access are non-refundable.
- Limitation of Liability
- No Warranties:
The Platform is provided “as is” and “as available”, without warranties of any kind, express or implied. - Service Interruptions:
The Platform shall not be liable for temporary interruptions of the service, or for the inability to access Content due to technical issues or maintenance. - Third-Party Content:
The Platform is not responsible for content generated by third parties, including advertisements or links to external websites.
- Amendments to the T&C
- The Platform reserves the right to amend these T&C at any time. Users will be notified of any changes, and their continued use of the Platform after notification will constitute acceptance of the new T&C.
- Governing Law and Jurisdiction
- These T&C shall be governed by and construed in accordance with the laws of Estonia. Any dispute arising in relation to these T&C shall be resolved before the competent courts of Tallinn.
